Legal Impacts to Airports from State Legalization of Marijuana

BACKGROUND

There are 20 states with legalized recreational use of marijuana or other controlled substances, and a vast majority of states allow marijuana for medical use. This impacts all aspects of the airport environment, including employment, contracting, and public safety.

OBJECTIVE

This digest would provide airports with guidance and analysis on the impacts of conflict between federal and state laws related to the use of marijuana. This should include:

  • Effects of Drug-Free Workplace Act requirements;
  • Employment practices, including screening and disciplinary actions;
  • Airport badging concerns;
  • Contract requirements and impacts for vendors, contractors, and tenants;
  • Americans with Disabilities Act compliance and issues;
  • Law enforcement and Fourth Amendment compliance; and
  • An appendix of state laws summarizing the legality of marijuana use and other similar controlled substances as otherwise prohibited by federal law.

STATUS: The final report is due December 2024.
