This Digest analyzes the relevant federal statutes, regulation and case law with regard to airport proprietary rights including regulation of noise and other environmental matters, safety restrictions, leasing practices, congestion management, and other airport access limitations.  This digest is a compilation of relevant statutes, regulations, and case decisions determining the scope of airport proprietary rights and a discussion of the rights within the owner’s purview and those which have been determined to exceed the owner’s authority.
